General Terms and Conditions

Article 1 – Definitions
In these general terms and conditions, the following terms are defined as:
· Entrepreneur: Kioku Jewellery, located in Almere, registered with the Chamber of Commerce under number [Chamber of Commerce number].
· Webshop: the entrepreneur's online store.
· Customer: any natural or legal person who enters into an agreement with the entrepreneur.
· Product: antique, vintage and second-hand jewellery and related articles.
· Agreement: any purchase agreement between the entrepreneur and the customer.
Article 2 – Applicability
1. These general terms and conditions apply to all offers, orders and agreements made via the webshop.
2. Deviations are only valid if agreed upon in writing.
3. The applicability of the customer's general terms and conditions is explicitly excluded.
Article 3 – Offer
1. All offers are non-binding.
2. Since these are unique antique and vintage pieces of jewellery, each product is only available once.
3. Apparent mistakes or errors in prices, images or descriptions are not binding on the entrepreneur.
4. Images are displayed as faithfully as possible, but colours may vary due to screen settings.
Article 4 – Product Information
1. The entrepreneur describes products as accurately as possible.
2. Antique and vintage jewellery are used objects and may contain traces of use, wear, discolouration, restorations or minor imperfections consistent with their age.
3. Such characteristics are not considered a defect if they can reasonably be expected.
4. Weights, dimensions, carat weights and stone sizes are indicative, unless expressly stated otherwise.
5. If known, information about origin, age and materials is provided. Historical datings are based on available knowledge and cannot always be determined with absolute certainty.
Article 5 – Formation of the Agreement
1. The agreement is concluded as soon as the entrepreneur confirms the order.
2. If a product unexpectedly turns out to be unavailable, the customer will be informed as soon as possible.
3. Amounts already paid will be fully refunded in that case.
Article 6 – Prices
1. All prices are stated in euros.
2. Unless stated otherwise, prices include VAT if legally applicable.
3. Shipping costs are stated separately before the order is finalised.
4. The entrepreneur reserves the right to change prices. Price changes do not affect agreements already concluded.
Article 7 – Payment
1. Payment is made via the payment methods offered in the webshop.
2. The entrepreneur may only ship an order after full payment has been received.
3. In the absence of payment, the agreement may be dissolved.
Article 8 – Delivery
1. Delivery takes place at the address provided by the customer.
2. Stated delivery times are indicative and not strict deadlines.
3. The entrepreneur is not liable for delays caused by carriers or force majeure.
4. The risk of loss or damage passes to the customer at the time of delivery.
Article 9 – Shipping Costs and Shipping
1. Shipping costs will be clearly stated in advance.
2. Orders are carefully packaged.
3. Jewelry is shipped insured/registered.
Article 10 – Right of withdrawal
1. Consumers have the right to dissolve the agreement without stating reasons for 30 days after receipt, unless a legal exception applies.
2. Within this period, the consumer must notify the entrepreneur of the withdrawal.
3. The product must be returned within 30 days of notification.
Article 11 – Conditions for returns
1. The product must have been handled with care.
2. Returns must be complete, securely packaged, and, if reasonably possible, in their original packaging.
3. The customer is liable for any depreciation in value resulting from use beyond what is necessary to assess the product.
4. The costs of return shipment are borne by the customer, unless otherwise agreed.
Article 12 – Exceptions to the right of withdrawal
The right of withdrawal may lapse if legally permitted, for example, in the case of:
· custom-made jewelry;
· personalized products;
· products modified at the customer's request.
Article 13 – Refund
1. After receipt and inspection of the return, the purchase amount, including the original standard shipping costs, will be refunded within 14 days at the latest.
2. The entrepreneur may withhold reimbursement until the product has been received or until the customer has demonstrated that it has been shipped.
Article 14 – Warranty and conformity
1. The entrepreneur guarantees that products comply with the agreement.
2. Due to the nature of antique and vintage jewelry, normal age-related wear is not considered a defect.
3. Defects described in advance or visible in photos are not covered by the warranty.
4. Statutory consumer rights remain fully in force.
Article 15 – Maintenance
1. Antique and vintage jewelry requires careful use.
2. The entrepreneur advises against wearing jewelry during sports, swimming, showering, or household chores.
3. Damage resulting from improper use is not covered by the warranty.
Article 16 – Retention of title
All delivered products remain the property of the entrepreneur until full payment has been made.
Article 17 – Liability
1. The liability of the entrepreneur is limited to the amount of the relevant order.
2. The entrepreneur is not liable for indirect damage, consequential damage, or loss of profit, unless there is intent or willful recklessness.
3. The entrepreneur is not liable for normal wear and tear or damage incurred after delivery due to use.
Article 18 – Force majeure
The entrepreneur is not obliged to fulfill obligations if this is impossible due to force majeure, including strikes, natural disasters, pandemics, disruptions by carriers, or government measures.
Article 19 – Intellectual property
All photos, texts, logos, and other content of the webshop are the property of the entrepreneur and may not be used or reproduced without written permission.
Article 20 – Privacy
Personal data will be processed in accordance with applicable privacy legislation and the entrepreneur's privacy policy.
Article 21 – Complaints
1. Complaints must be reported in writing or by e-mail within a reasonable period after discovery.
2. The entrepreneur aims to respond to complaints within 14 days.
3. If a complaint requires more time, the customer will receive a message indicating the estimated processing time.
Article 22 – Applicable Law
All agreements are exclusively governed by Dutch law.
Article 23 – Disputes
Disputes shall be submitted to the competent court in the Netherlands, unless mandatory consumer law dictates otherwise.

Anti-Money Laundering Policy:
Kioku Jewellery is committed to combating money laundering and terrorist financing. This policy has been drawn up to comply with the legal requirements of the Money Laundering and Terrorist Financing (Prevention) Act (Wwft) and to safeguard the integrity of our business operations.
Payment Methods
• Kioku Jewellery exclusively accepts payments via our payment partner Mollie. We allow payments via iDeal, Credit Card, Klarna, in3, Bancontact, GiroPay and direct transfer via SEPA. We also accept our own Kioku Jewellery Gift Card.
• Cash payments are not accepted.
Customer Information and Identification
• For every purchase, a customer is obliged to provide their name, address, and email address. Only customers with a residential address are accepted; PO box and business addresses are refused.
• In case of cancellation or return of an order, the purchase amount will only be refunded in the same way as the original payment.
International Payments: Payments are only accepted from the following countries: Netherlands, Belgium, Denmark, Germany, Finland, France, Italy, Luxembourg, Austria, Portugal, Spain and Sweden.
External Control and Legislation:
• Our accounting is audited by A. de Groot, under the supervision of the Bureau Financieel Toezicht (BFT).
• Kioku Jewellery complies with the requirements of the Wwft and provides the necessary information for customer due diligence or when reporting unusual transactions to the Financial Intelligence Unit Netherlands (FIU).
Customer Due Diligence
• Customer due diligence includes establishing the customer's identity, verifying their authorization to represent, and monitoring unusual transactions.
• In case of refusal to cooperate with the due diligence or providing false information, the transaction will be cancelled or refused.
